Disallowance motion 24 September 2014- Non contributory parent and aged parent, aged dependent relative, remaining relative and carer visas ( Information received from MIA)
Senator Hanson-Young will move a disallowance motion against the Migration Amendment (Repeal of Certain Visa Classes) Regulation 2014, as contained in Select Legislative Instrument 2014 No. 65 [F2014L00622], which ceased the non contributory parent and aged parent, aged dependent relative, remaining relative and carer visa subclasses on 24 September 2014.
IF the disallowance motion is successful, there may be a short period of time to again lodge applications for these visa subclasses before moves are made to again close these pathways.
If clients have applications that could be lodged prior to the cessation, they may consider whether these may be validly lodged during this period.
Please note that for Subclass 804 Aged Parent visa there is no legislative instrument specifying where the application must be lodged and therefore no legal impediment to lodging the application at any immigration office.
If you have to lodge any of the above mentioned visa or discuss about the options please contact us as soon as you can.
